These Terms & Conditions (“Terms”) govern the access to and use of the website, web applications, and mobile applications (collectively, the “Platform”) operated by FundsApp Wealth Technologies Pvt Ltd (“FundsApp”, “we”, “us”, “our”).

By accessing, registering on, or using the Platform in any manner, you (“User”, “you”, “your”) agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Platform.

1. Definitions

For the purpose of these Terms:

• “Platform” means the website, web applications, and mobile applications operated and managed by FundsApp.
• “Services” means technology-enabled services relating to mutual fund onboarding, portfolio viewing, reporting, transaction facilitation, and related features.
• “Investor” means an individual user accessing the Platform for personal investment-related purposes.
• “Partner” or “MFD” means a mutual fund distributor accessing the Platform for professional purposes.
• “User” refers collectively to Investors, Partners, and other authorised users.

2. Eligibility

• You are at least 18 years of age and legally eligible to enter into a binding agreement.
• You are competent and authorised to use the Platform.
• All information provided by you is true, accurate, and complete.

FundsApp reserves the right to suspend or deny access if eligibility requirements are not met.

3. Nature of the Platform

FundsApp is a technology platform facilitating access to mutual fund related services for Investors and Partners.

• Acts as a technology enabler
• May act as a mutual fund distributor registered with AMFI (ARN: 327453)
• Does not operate or manage any mutual fund schemes

4. Scope of Services

• Investor onboarding and KYC workflows
• Portfolio viewing and consolidated reporting
• Transaction-related facilitation, where enabled
• Communication and service-related features
• Partner tools for investor management

FundsApp may modify, suspend, or discontinue any part of the Services at its discretion.

5. Use of the Platform

5.1 Investors

Investors may use the Platform for personal, non-commercial investment-related purposes.

5.2 Partners / MFDs

Partners may use the Platform strictly for professional purposes in accordance with applicable laws and AMFI guidelines.

Users agree not to misuse the Platform, access data without authorisation, interfere with operations, or use the Platform for unlawful purposes.

6. Information, Views, and Recommendations

The Platform may include information or insights for educational purposes only. Such information does not guarantee performance and is not binding.

FundsApp does not act as a SEBI-registered investment adviser and does not provide personalised investment advice.

7. User Responsibilities

• Users are responsible for their own investment decisions
• Users will independently evaluate risks and suitability
• Users will comply with applicable laws and regulations

8. Account Security and OTP Responsibility

Users are responsible for maintaining confidentiality of login credentials, passwords, OTPs, and verification codes.

FundsApp shall not be liable for losses arising from misuse or disclosure of such credentials.

9. Third-Party Information and Integrations

The Platform may rely on third-party data from registrars, KRAs, AMCs, and other service providers. FundsApp does not guarantee accuracy or completeness of such data.

10. Intellectual Property

All Platform content is the property of FundsApp or its licensors and is protected under applicable intellectual property laws.

Third-party trademarks and logos remain the property of their respective owners.

11. Privacy

Use of the Platform is subject to the Privacy Policy, which forms an integral part of these Terms.

12. Disclaimers

The Platform and Services are provided on an “as is” and “as available” basis. FundsApp does not guarantee uninterrupted access or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, FundsApp shall not be liable for investment losses, indirect damages, data inaccuracies, or platform downtime.

14. Indemnity

Users agree to indemnify and hold harmless FundsApp from claims arising out of misuse of the Platform, violation of these Terms, or breach of law.

15. Suspension and Termination

FundsApp may suspend or terminate access in case of violations, legal requirements, or security risks.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts at Chennai, Tamil Nadu shall have jurisdiction.

17. Changes to Terms

FundsApp may update these Terms from time to time. Continued use indicates acceptance of revised Terms.
